use apply to the entire group of web sites
owned, operated, licensed, or controlled by the
Maryland Workers' Compensation Commission
(MDWCC). Please read these terms and conditions
carefully before using this web site.
By using this web
site or any other site owned, operated,
licensed, or controlled by MDWCC, you signify
your assent to these terms of use. If you do not
agree to these terms of use, you may not access
or otherwise use the site. MDWCC reserves the
right, at its discretion, to change, modify,
add, or remove portions of these terms at any
time. Please check these terms periodically for
changes. Your continued use of this site or any
other MDWCC web site following the posting of
changes to these terms will mean you accept
those changes.
As a condition of
your use of MDWCC web sites, you agree that you
will not use MDWCC web sites for any purpose
that is unlawful or prohibited by these Terms.
You may not use MDWCC web sites in any manner
that could damage, disable, overburden, or
impair the Site or interfere with any other
party's use of the Site. You may not obtain or
attempt to obtain any materials or information
through any means not intentionally made
available or provided for through the Site.
Additionally, you agree that you will not:
(i) take any action that is likely to impose an
unreasonable or disproportionately large load on
our infrastructure; (ii) interfere or attempt to
interfere with the proper working of the MDWCC
web sites; or (iii) bypass our robot exclusion
methods or other measures we may use to prevent
or restrict access to MDWCC websites' services.
Methods of
Access
The MDWCC web sites'
inquiry services may be used only by a human
being using a conventional web browser to
manually enter queries one at a time. If our
monitoring systems detect an attempt to access
the service in a forbidden way, to execute
systematic patterns of queries, to index the
website, or to do anything else that we feel
jeopardizes the integrity of our system or
access to it by other users, we may terminate or
suspend access to the service for specific users
or IP ranges.
Prohibited
Actions
Any activities that
adversely affect the ability of other people or
systems to use MDWCC services or the Internet
are prohibited.
You may not use bots,
screen scraping, or similar data gathering and
extraction tools on MDWCC web sites. Any
attempts to use a bot, script, or other data
mining tools to repeatedly access MDWCC's data
could place an unacceptable load on the systems,
and is strictly forbidden.
Attempting to
circumvent user authentication or security of
any host, network, or account (aka
"hacking\cracking") is strictly prohibited. This
includes, but is not limited to, accessing data
not intended for the User, logging into a server
or account the User is not expressly authorized
to access, or probing the security of the
servers and networks.
Mail abuse
(including, but not limited to, mass mailing
unsolicited email and email forgery); Use of
MDWCC's web site services to provide software or
lists for mass mailing unsolicited email is
prohibited.
Data Mining and Denial of Service
MDWCC web assets are intended for use by the
general public. Any activity or operation,
whether generated automatically or manually,
that results in or has the potential to result
in denial or decrease of service for other
customers may be denied access to MDWCC web
resources without notice. Due to limitations of
equipment and bandwidth, MDWCC webs sites are
not intended to be a source for bulk downloads
of MDWCC data. Anyone using data mining software
will have access blocked. |

| Acceptable Use Policy
Violation of the following use policy will result in suspension or revocation of subscriber access. Violation includes but is not limited to the following:

Using Online Services to locate, solicit and contact unrepresented claimants is expressly prohibited.

Allowing others (anyone besides yourself) to use your password or password sharing is expressly prohibited.

Subscribers are required to keep an up-to-date email address or their access will be terminated.
| Termination or Access Restriction
WCC reserves the right, in
its sole discretion, to terminate your access to Online Services
without notice. WCC may also terminate or suspend your access to
Online Services for inactivity, which is defined as failing to
log into a particular service for an extended period of time, as
determined by WCC. Upon termination of service, your right to
use the Online Services immediately ceases. | Attorney Proxy
Registered, authorized
"attorney proxy" designees are subject to all terms, conditions
and notices of this agreement. All proxy activity is the
responsibility of the subscriber and their designator
(subscribed Attorney). As such, both parties are subject to the
terms, conditions and penalties prescribed. | Insurer Delegate
Registered, authorized "insurer delegate" designees are subject to all terms, conditions and notices of this agreement. All delegate activity is the responsibility of the subscriber and their designator (subscribed Insurer). As such, both parties are subject to the terms, conditions and penalties prescribed. | Healthcare Provider Delegate
Registered, authorized "healthcare provider delegate" designees are subject to all terms, conditions and notices of this agreement. All delegate activity is the responsibility of the subscriber and their designator (subscribed Healthcare Provider). As such, both parties are subject to the terms, conditions and penalties prescribed. | Digital Signing and eForms
Subscribers who access WCC electronic forms (eForms) agree that digital (signature) credentials will not be divulged to others. Submission of WCC forms online is a service provided to the subscribed WCC community. WCC acceptance of eForms requires the subscriber fully adhere and agree to all conditions prescribed in this Terms of Service.
Access to eForms requires
Formatta Forms software.com to view, complete and sign WCC forms. Subscribers are required to download and install Formatta software, which is provided free of cost by Formatta.
It is the subscriber's responsibility to ascertain that electronic receipt of eForms is recorded on the WFMS system via review of electronic documents filed during WFMS session. No "grace period" or extension of statutory limits is provided if a subscriber's eForm submission is not received by the WCC/WFMS web server. | eForms Attachments (on forms allowing file attachments)
A "secured document" is a
medical record, a record that contains personal financial
information or a record that contains information not subject to
public inspection under Maryland Code Annotated, State
Government 10-601 et seq. An attached document identified as
a "secured document" will be blocked from public access. A
"medical record" is any record that relates to the health care
of the patient or recipient. "Personal financial" information
includes, but is not limited to assets, income, liabilities, net
worth, bank balances, financial history or activities or credit
worthiness.
An "unsecured document" is a record that does not contain medical information or personal financial information or any information prohibited from inspection under Maryland Code Annotated, State Government 10-601 et seq. A document identified as "unsecured" will not be blocked from public access.
While this web site (WCC) takes every precaution to protect its users' information, the Workers' Compensation Commission is not responsible for the identification of the attached claim-related documents nor is the Workers' Compensation Commission liable for the misidentification of the attached claim-related documents submitted by an authorized subscriber. Such subscriber must review and understand the information above and accept responsibility for the identification of the attached claim-related documents.

WCC reserves the right to change the terms, conditions, and notices without prior notice under which Online Services are offered, including but not limited to any charges associated with the use of Online Services. You are responsible for regularly reviewing these terms and conditions. Your continued use of Online Services constitutes your agreement to all such terms, conditions, and notices. | Privacy and Protection of Personal Information
This web site collects personal information in order to provide service. This information is kept confidential and is not disclosed to third parties, except as permissible under the Public Information Act, Maryland Code Annotated, State Government 10-611 through 10-628. WCC may disclose personal information to Federal and State Law Enforcement Authorities to enforce the Maryland Workers' Compensation Commission's rights against unauthorized access or inappropriate use of the web site. | Disclaimer of Third Party Products and Services

By agreeing to electronic delivery I am giving my informed consent to electronic delivery of all Agency Communications (defined below), other than those I have specifically requested be delivered in paper form. "Agency Communications" mean all current and future form filing confirmations, notices, disclosures, and other information, documents, data and records regarding my WCC Subscriber Account and the workers' compensation claims on file with WCC to which I am a registered party.
Revocation of Consent. I may revoke or restrict my consent to electronic delivery of Agency Communications anytime, subject to the terms of this Agreement, by updating my WCC Subscriber Profile online.
Electronic Delivery System. WCC will notify me by e-mail when notices or forms have been filed and are available on the WCC Web site for workers' compensation claims on file with WCC and to which I am a registered party. I will have access through the WCC Web site to all documents I received via electronic delivery. All e-mail notifications of Agency Communications will be sent to my e-mail address of record.
I acknowledge that the Internet is not a secure network and that communications transmitted over the Internet may be accessed by unauthorized or unintended third parties. E-mail notifications sent by WCC will not contain sensitive or confidential information, including social security numbers, financial and medical information. Due to security risks, I will not send any sensitive information, such as social security numbers, financial and medical information in an unencrypted e-mail. E-mails on rare occasions may fail to transmit properly. Regardless of whether I receive an e-mail notification, I agree to check the WCC Web site regularly for up-to-date information and to avoid missing time-sensitive information. I agree that, for my records, I can download and save or print the Agency Communications I receive via electronic delivery.
I understand that WCC reserves the right, however, to post Agency Communications on the WCC Web site without providing notice to me, send Agency Communications to my postal or electronic address of record I have registered with WCC. I agree to check the WCC Web site regularly as I may have no other means of knowing that information and Agency Communications have been delivered to me. I agree that all Agency Communications provided to me in any of the ways described above will be deemed to have been good and effective delivery to me when sent or made available on the WCC Web site by WCC, regardless of whether I actually or timely receive or access the Agency Communication. I agree to promptly and carefully review all Agency Communications as and when delivered.
Duration of Consent. This consent will be effective immediately and will remain in effect unless and until either I or WCC revoke it. I understand that it may take up to five (5) business days to process a revocation of consent to electronic delivery, and I may receive electronic notifications in the interim.
Hardware or Software Requirements Needed to Access Electronic Records. I understand that to receive electronic deliveries, I must have Internet access, a valid e-mail address, the ability to download such applications as WCC may specify and to which I have access and a printer or other device to download and print or save any information I may wish to retain. WCC will notify me of any changes in the hardware and software requirements needed to access electronic records covered by this consent.
Consent and Representations. I hereby agree that I have carefully read the above information regarding informed consent and fully understand the implications thereof. I hereby agree to the conditions outlined above concerning electronic delivery of Agency Communications. I also agree that I will maintain a valid e-mail address and continue to have access to the Internet. If my e-mail address changes, I agree to notify WCC of my new e-mail address immediately in writing (for example, by submitting a completed change of e-mail address electronically through the WCC Website). |
