            <title>Provision of the Authorization for Release of Medical Information</title>
            <description>Reminder to Practitioners:
Pursuant to COMAR 14.09.01.09, while the Employer/Insurer is charged with the responsibility of requesting medical records in a timely fashion, the Claimant is similarly charged with the responsibility of assisting the Employer/Insurer to secure such records in a timely manner. That responsibility includes providing the Employer/Insurer with a properly executed medical release for relevant medical records upon request. our  Authorization for Release of Medical Information. is available on our Forms &amp; Instructions page.

Note that failure to provide a medical release upon request may cause a scheduled hearing to be postponed</description>

            <title>REMINDER TO PRACTITIONERS: Best Practices -– Use of Commission Subpoenas</title>
            <description>Please be advised that pursuant to Labor &amp; Employment Article § 9-311, Commission subpoenas may be used only to compel a witness to attend, give testimony and produce documents or records at a Commission hearing or, in very limited cases, at deposition (a deposition may only be taken to perpetuate testimony and not for discovery purposes). See Md. Code Ann., Labor &amp; Empl. § 9-719. See also Md. Rule 2-510.

As in the usual civil practice, a party may elect to permit the subject of the subpoena, particularly a custodian of records, to produce the subpoenaed documents or records to the requesting party prior to the scheduled hearing, and, thus, avoid compulsory attendance at the hearing. Such a request may be made by cover letter attached to the subpoena.

Parties are encouraged to use the mandatory medical authorization/release to obtain relevant medical records when possible.

With regard to a Subpoena of Medical Records, practitioners must comply with Health General Article § 4-306 and give notice to the patient of an intent to subpoena medical records and provide a copy of the subpoena. If there is any dispute or objection to the production of the medical records, an Objection (WCC Form H-08/OTS) must be filed with the Commission no later than 30 days from the date of Notice.

            <title>Proposal to amend COMAR 14.09.01.07 -  Average Weekly Wage</title>
            <description>The Workers&apos; Compensation Commission proposes to amend Regulation .07 under COMAR 14.09.01 Procedural Regulations.  This action was considered at a public meeting held on June 14, 2012, notice of which was given by publication in 39:9 Md.R. 636 (May 4, 2012) pursuant to State Government Article, §10-506(c), Annotated Code of Maryland.  The purpose of this action is to establish a clear procedure and time line for determining the average weekly wage. Specifically, that the average weekly wage be adjudicated at the first hearing before the Commission, and that if the Commission finds that an inaccurate weekly wage resulted in an over payment or under payment of benefits the Commission may order a credit against future permanent disability benefits, the payment of additional compensation or any other relief the Commission determines is appropriate.

            <description>The Workers’ Compensation Commission proposes to amend Regulation .05 under COMAR 14.09.06 Local Office Requirements for Insurers. This action was considered at a public meeting held on March 22, 2012, notice of which was given by publication in 39:4 Md. R. 358 (February 24, 2012) pursuant to State Government Article §10-506(c), Annotated Code of Maryland. The purpose of this action is to remove COMAR 14.09.06.05B, which requires an appellant’s attorney to send a copy of a petition for judicial review to the Attorney General representing the Commission if the issue being appealed is the award of attorney’s fees. This provision is being removed from this chapter so that it may be transferred and recodified into a more thematically appropriate chapter. Comments may be sent to Amy S. Therefore, Agreements of Final Compromise and Settlements submitted to the Commission for approval shall include the date of disablement by accidental injury or occupational disease.  This information is now required on the MDWCC form Settlement Worksheet H-07, item #23.             <title>New : COMAR 14.09.01 Regulation .06 and new Regulation .06-1 effective March 19,2012</title>
            <description>On February 23, 2012, the Workers’ Compensation Commission adopted amendments to Regulation .06 and new Regulation .06-1 under COMAR 14.09.01 Procedural Regulations to implement the statutory changes made by the General Assembly in Ch. 436, Acts of 2011. These statutory changes, effective October 1, 2011, concern the death benefits paid to surviving dependents. The law also enables counties and municipal governments to opt into the new death benefits scheme. This action, which was proposed for adoption in 38:27 Md. R. 1781—1782 (December 30, 2011), has been adopted as proposed.  Regulations are effective March 19, 2012..</description>

            <description>Delia Turano Schadt, a native of Cumberland, Maryland graduated from James Madison University with a Bachelor of Science Degree in Political Science in 1989. She earned her Juris Doctor from The University of Dayton School of Law in 1992. She then served as law clerk to The Honorable J. Frederick Sharer and The Honorable Gary G. Leasure in the Circuit Court for Allegany County. She began her legal career practicing workers’ compensation law and was employed by the Injured Workers’ Insurance Fund from 1993 until 2000. Following this, she was employed with the Maryland Office of the Attorney General where she served as Board Counsel to health occupation licensing boards until being appointed to the Maryland Workers’ Compensation Commission by Governor Martin O’Malley in 2011.</description>

            <description>Issues form H24R is revised and now posted to WFMS Online Services and the WCC Forms page.  Please begin using the new form immediately.  We will not accept any prior versions of the form after September 30, 2011.  This revision contains several updates, including layout &amp; format, the selection of parties raising issues and newly required information when requesting authorization for medical treatment.  The Issues form must include a brief description when a request for authorization of medical treatment is submitted.

Note that this change also affects all WFMS Online Services forms that utilize Issues (H24R) as page 2.</description>

            <description>Cost of Living Adjustment (COLA) for Calendar Year 2012:  Section 9-638 of the Labor and Employment Article provides for an annual cost of living adjustment (COLA) for compensation paid under Subtitle V to covered employees with a permanent total disability.  The COLA provision became effective January 1, 1988 and is only payable for an accidental injury or occupational disease sustained on or after January 1, 1988. The cost of living adjustment effective on January 1, 2012 is 1.6%.  See MD Compensation Rates for more information</description>

            <description>It has come to the attention of the Commission that some appeals of an award of attorney’s fees are not in compliance with COMAR 14.09.06.05B, “When the issue appealed is the award of attorney’s fees, the appellant’s attorney shall forward a copy of the petition for judicial review to the Attorney General assigned to represent the Commission.&quot;  Please remember that this is a regulatory requirement and should be followed at all times.

            <description>Effective July 1, 2011, awards subject to LE § 9-806 (Subsequent Injury Fund Assessment) and LE § 9-1007(B) (Uninsured Employer Fund Assessment), will be billed separately by the two funds.  Award Orders issued by the Workers’ Compensation Commission will contain new language to reflect this billing and collection procedure change.  Employers or Insurers must pay the assessments to the two funds within thirty (30) days of their respective invoices.</description>

            <title>Procedures for hand-delivered Employee Claim forms to WCC Public Service office are improved</title>
            <description>Effective immediately, when an Employee Claim Form C-1 is hand-delivered to the Commission, Public Service staff will review the form and verify that it meets all requirements under COMAR 14.09.01.06 before accepting and dating the form.  We only accept documents for filing at our Baltimore City Public Service Office located at 10 East Baltimore Street, 4th floor, Baltimore, MD, 21202 during normal business hours. 

The quality assurance process will require additional time and we appreciate the community&apos;s patience and cooperation.</description>
